A motion by the defendants to dismiss our lawsuit on technical grounds has been rejected in its ENTIRETY by the court! The decision essentially states that after due consideration, ALL of the defendants' various contentions were found to be without merit. CLICK HERE for Judge O'Connor's complete Decision and Order. Note: The first paragraph of this decision and order summarizes the various actions by the defendants that are the subject of our lawsuit against them. With this decision, the litigation is expected to pick-up speed. Next up, we hope to get a timely and favorable decision on our request for an injunction BEFORE teams make their registration plans for the upcoming summer season. An injunction would forbid under law, while this litigation is in progress, the defendants from coercing Cal Ripken and Babe Ruth members to purchase travel league services from a vendor designated by the defendants. The injunction would immediately give all Babe Ruth and Cal Ripken members the opportunity to freely choose which travel league they prefer to play in without fear of retaliation or retribution from Jerry Francis, Cal Ripken and/or Babe Ruth, Inc.
