Player Tampering - Request For Your Feedback

Dear Club Owners, Club Coordinators, Team Managers and Coaches:After reading this piece on tampering, please write me to voice your opinion on whether you think our league rules on this subject are appropriate. Please make whatever suggestion you like for modification, including the possible elimination of all player restrictions or tampering controls. The system we have recently implemented in Utica recognizes the inherent difficulty of enforcing tampering protocols. Utica has transitioned from an ENYTB system to one with an open season on player movement (essentially, tampering is defined as legal within a limited timeframe) - from the end of the summer league season until Nov 1. During that period players can switch teams merely by signing a Player Transfer form (players are also limited to one new commitment each year). The club/team also signs the form, indicating they are accepting the player, and they file that form with the league no later than Nov 1. On Nov 1 all player movement is frozen until the end of the following season. ENYTB could changeover to the same or similar system if that is what we wanted. I am not recommending anything, I'm just throwing things out to you because I sense that people are not following our rules the way they should. Maybe the nature of the beast is such that a system with limited open season on player movement or, another system altogether, would better protect/promote your interests.I do know that the current system is not working very well. Here we are entering Feb, and players and teams are coming out of the woodwork with release requests. Not surprisingly, the players seeking releases are among the league's best players. In many cases, I sense the parent is playing one club against another. This could not happen if league members stuck together and followed our current rules but it is obvious in most of these cases that league procedures have not been followed. Anyway, read my explanation below of teh current system and if you have constructive thoughts please send them on to me. The current system will remain in place for 2008 (too late to change) but, depending on your feedback, I will propose a new system or amended system for 2009 before the 2008 regular season is over.-------------------------------As is the case every year this time, numerous complaints of player tampering are being filed by clubs against one and another. Besides telling everyone to read and follow the rules laid out in our constitution re: player restrictions and anti-tampering protocols(Articles XVI and XVII), I will provide the following nutshell explanation .... This league is essentially owned by and operated for, the benefit of its members. You have asked that certain restrictions/regulations be imposed re: player acquisition. We call them player restrictions. The restrictions adopted by this league were unanimously adopted by a full membership vote in days gone by. These restrictions were designed to benefit members by giving them some control over player movement, and thereby certainty and stability in the operation of their club/teams from one year to the next. The essential idea behind our restrictions was: who would play in a league where your fellow members could recruit your players w/o restriction???In regards to player restrictions, ENYTB recognizes three classes of player status as follows:(1) Unrestricted Free Agents;(2) Restricted Free Agents;These are players aged 15 yo and younger who have never played in this league and who reside within the franchise area of a full franchise member. Note: ENYTB currently has 32 franchise members - to see areas where these restrictions apply, go to Inside The League > Members.(3) PROTECTED Players - Includes any player that played in this league last year.***As implied, there are no restrictions on adding a type 1 player.***There are mild restrictions on signing a type 2 player w/o a release. Type 2 players are eligible for a special "non-discretionary" release, provide they qualify under the league protocol for a non-discretionary release.***There are strong (almost ironclad) restrictions on signing a type 3 player w/o a release. Releases in this case are voluntary on the part of the club i.e., discretionary. Certain exemptions are allowed, as specified in the constitution.Any player that can not obtain a release, can become an Unrestricted Free Agent by sitting out of league play for one year, similar to the college red-shirt rule.The above terms are defined in the league's online glossary and in its anti-tampering protocol, spelled out in excruciating detail for type 2 and type 3 players in Article XVII of our constitution (available online League Info > Governance > Constitution. IN ALL CASES, TO AVOID BEING GUILTY OF TAMPERING, CLUBS/TEAMS MUST INFORM THEIR FELLOW MEMBER WHEN ANY Type 2 or Type 3 PLAYER INITIATES CONTACT WITH THEM FOR THE PURPOSE OF EXPLORING THE POSSIBILITY OF PLAYING FOR THEM. This phone call or email contact to your fellow member should be immediate, regardless of your interest in that player. (This would not apply to an open tryout advertised in a local newspaper.) This information should be held confidential i.e., you don't tell the player I hear you are shopping around for a new team.Thus, failure to immediately inform your fellow member of first contact from a type 2/3 player constitutes tampering under our current rules!!!Now let's turn it around and say that your club/team wants to initiate contact with another club's type 1 or type 2 player.BEFORE initiating contact you must get PERMISSION from his current club to contact him. If you are denied permission, you can NOT contact that player or you are tampering!!!I am currently spending several hours per day refereeing numerous tampering disputes between members because NOBODY EVER CONTACTED ANYONE FROM THE PLAYER's CURRENT CLUB TO NOTIFY THEM that contact was initiated by the player or that they would like to initiate contact with the player. Wouldn't all of you like to know when your players are shopping around? Maybe the problem with the player is fixable if you can intervene in the process soon enough. Also, wouldn't all of you like to know when one of your players is the target of another club's wandering eye? This would at least allow you to plan ahead in terms of finding a replacement.The lowest level penalty for tampering is the tampered player can NEVER play for the club that did the tampering. It was believed that penalty would be a sufficient incentive to get everyone to immediately phone or email their fellow member when one of their players is out shopping around OR if you want to shop around. In conclusion, player restrictions, our release system, our anti-tampering protocol, including providing immediate notification to the player's current club, as well as our membership rules that protect existing members from being cannabilized by new members are the foundation of this league. PLEASE DO YOUR BEST TO ABIDE BY THESE RULES AND COOPERATE WITH YOUR FELLOW MEMBERS IN THESE MATTERS, PER OUR CONSTITUTION.Thank you.Ed
