We are not trying to be vindictive but it is the responsibility of this Board to make whatever hard choices are necessary to protect the quality of the ENYTB product as well the long-term viability of the League. Players are the lifeblood of any League. As a general matter, it would not be in this League's long-term interest to provide members of this League with player protection when they use that protection to funnel players to their teams in a rival travel league. We believe the interests of this League are best served by providing our "exclusive" members (i.e. those who support ENYTB at all age divisions in which they have active travel teams) with every advantage possible in developing and maintaining strong and viable franchises. The best way to do that in this instance is by allowing our exclusive members to have free access to players in the territories of, and under certain circumstances, the rosters of ENYTB members participating in any rival league, including their ENYTB teams as well as their non-ENYTB teams. In response to the increasingly hostile and predatory actions of rival travel leagues, the following policy was unanimously approved by ENYTB's Executive Board on January 24, 2006 with all members present except Jeff Pexton, Director, John Johnson, Commissioner and one vacant Director position. Vote was 7-0. (i) Any ENYTB member that registers ANY team in the upper division of the Babe Ruth only travel league, shall have its membership status, territory protection and ENYTB voting rights suspended for the duration of their participation in that League.(ii) Any ENYTB member that participates in the upper division of the Babe Ruth only travel league AND fails to participate in ENYTB at ANY age division from 13 to 15, shall have its membership status, all its player protection rights in ENYTB, including both territory-based rights and roster protection, for all their ENYTB teams, as well as their ENYTB voting rights, suspended for the duration of their participation in that League. During the period of their suspension their territory may be permanently reassigned to another member and their member status altered accordingly: Franchises could be downgraded to co-franchises or sub-franchises and co-franchises could be downgraded to sub-franchises; (iii) Any ENYTB team participating in any rival League that takes a player off the roster of any team owned by an exclusive ENYTB member for purposes of participation in that rival League or any other purposes shall have its membership privileges permanently revoked immediately upon determination of any such violation. The League shall cancel that member's website access privileges and cancel ALL remaining games for ALL his teams, forfeiting all remaining games on the schedule of each team. All teams of that member shall be ineligible for any further ENYTB play, including both regular season and post-season play through ENYTB. That member also shall NOT be entitled to any refund of his registration fees, even if said violation occurs before the regular season is underway. (iv) Any ENYTB member that has a team in ENYTB's 15U division in the prior year and chooses not to continue in ENYTB at 16U in the current year, instead choosing to play in the "old" Easter NY Mickey Mantle League, controlled by the Henkel brothers and Phil Babie of No. Colonie Babe Ruth, shall have ALL of its player protection rights in ENYTB, including both territory-based rights and roster protection, for all their ENYTB teams, as well as their ENYTB voting rights, suspended for the duration of their participation in that League. During the period of their suspension their territory may be permanently reassigned to another member and their member status altered accordingly: Franchises could be downgraded to co-franchises or sub-franchises and co-franchises could be downgraded to sub-franchises;The same penalty shall apply to any ENYTB member that switches a team from ENYTB to the Eastern NY Connie Mack League, also controlled by the same parties, as it ages up; and, Note: Provision (iv) represents a marked policy shift for ENYTB. Prior to last year we maintained a friendly policy towards the Henkel/Babie leagues - if you were an ENYTB member at 13-15 and switched at 16-18 to Henkel/Babie: •you could DR with us at 16/18 to get NABF/PONY sanctioning; •you could DR with us at 16/18 to get extra "quality" games; •you could DR with us at 16/18 to get ENYTB player protection for 16/18 team; •whether you DR with us or not at 16/18, you still maintained player protection at 13-15.All of these "friendly" policies went out the window because of the hostile actions of Joe Henkel towards ENYTB. By not controlling Henkel i.e., by letting him pocket veto last year's mergers, screw with our scheduling and attack us on all fronts this year, including all age divisions and all affiliations, the members of the Henkel/Babie leagues are indirectly responsible for this policy shift by ENYTB. On the one hand many members of that League want the benefits of being an ENYTB member yet they support the relentless drive of Henkel/Babie to harm this League. You can't have it both ways. It is not in the best interests of this League to protect a member's players at 13-14-15 only to watch them delivered into the hands of a hostile enemy at 16-18. The days of this League being a "safe haven" feeder program for the increasingly hostile Henkel/Babie leagues are over. (v) Any ENYTB member that registers ANY team in the Babe Ruth only travel league, the ENYMML or the ENYCML and postpones or cancels games in this League because of conflicts with scheduled or rescheduled games in those Leagues or engages in any behavior that is disruptive to the ENYTB scheduling process shall have its membership privileges permanently revoked immediately upon determination of any such violation. The League shall cancel that member's website access privileges and cancel ALL remaining games for ALL his teams, forfeiting all remaining games on each schedule. All teams of that member shall be ineligible for any further ENYTB play, including both regular season and post-season play through ENYTB. That member also shall NOT be entitled to any refund of his registration fees, even if said violation occurs before the regular season is underway. Note: The Lansingburgh Royals membership was revoked under rule (v) in 2005. (vi) All ENYTB members that are Babe Ruth members shall be required for the 2006 season to activate and pay the base registration fee for each of its ENYTB teams by March 1 in order to preserve its territory (if applicable) and roster protection rights (if applicable) for the current season. This is necessary so that the League can properly plan its expenditures and so that other members can react to changes in another member's player protection status in time for the upcoming season. Once paid, the base registration fee shall not be refundable. Failure to activate and pay said fee shall be assumed to represent both participation in a rival League and non-participation in ENYTB. ENYTB members who are not registering teams with ENYTB in all age divisions 13 thru 15 but are NOT participating in a rival League shall notify the League Office prior to March 1 to ensure preservation of all membership rights. Any ENYTB member that falsely notifies the League Office of its intention NOT to participate in a rival League shall have its membership privileges permanently revoked immediately upon determination of any such violation. The League shall cancel that member's website access privileges and cancel ALL remaining games for ALL his teams, forfeiting all remaining games on each schedule. All teams of that member shall be ineligible for any further ENYTB play, including both regular season and post-season play through ENYTB. That member also shall NOT be entitled to any refund of his registration fees, even if said violation occurs before the regular season is underway. Thus, participation in the upper division of the new BR travel league or the ENYMM16/ENYCM18 Leagues by ENYTB members will open opportunities to ENYTB's exclusive members, totaling more than 100 independent teams as well as additional exclusive Babe Ruth members, to acquire players from the territories, and possibly rosters of any non-exclusive ENYTB member. These new "open" areas and unprotected rosters should prove to be fertile hunting grounds for ENYTB's exclusive members once the better players understand that their travel teams are in a Babe Ruth only travel league where the level of play is far below that of ENYTB, the games are few, the opponents are few and the competition is often lopsided. ENYTB will make official announcements of the names of members forfeiting their territory and/or roster protection rights under provisions (i), (ii). (iii), (iv), (v) and (vi) above. At that time ENYTB's exclusive members shall be free to contact these players and sign them. Players remain eligible for placement in the current season until they have participated in three ENYTB games for another ENYTB member.
